Every source gave us different information. Some said we needed €4,500, others said more. Some mentioned business experience requirements that didn't exist. It took us weeks to piece together the real requirements.

Requirement 1: US Citizenship

DAFT is exclusively for US citizens. This is non-negotiable.

  • Naturalized US citizens — Yes

Who Doesn't Qualify

  • Green card holders — No, unfortunately
  • US visa holders — No
  • Former US citizens — No (unless you have current citizenship)

Common Questions

Can I apply as a dual citizen? Yes. Use your US passport for the DAFT application. Your other citizenship doesn't affect eligibility.

What if I was born abroad to US parents? If you have US citizenship (born abroad to US citizens qualifies), you're eligible. You'll need your Consular Report of Birth Abroad (CRBA) or US passport.

Does my spouse need to be a US citizen? No. Your spouse can come as your dependent regardless of their citizenship.

Requirement 2: Clean Criminal Record

The IND (Dutch Immigration) reviews your background. Here's what you need to know.

What the IND Looks For

  • Serious criminal convictions — May disqualify
  • Recent criminal activity — More scrutiny for recent offenses
  • Pattern of offenses — Multiple issues raise red flags

What Usually Doesn't Disqualify

  • Minor traffic violations — Generally okay
  • Old misdemeanors — Especially if 10+ years ago
  • Dismissed charges — Not usually an issue

The FBI Background Check

You'll need an FBI Identity History Summary. This shows your federal criminal record (or lack thereof).

Important Notes

The background check process takes 4-8 weeks, and then you need to get it apostilled — start this immediately, as it's often the longest part of document gathering.

The FBI check must be:

  • Recent (within 6 months of application)
  • Apostilled by the US State Department
  • The original document (not a copy)

Requirement 3: Business Requirement

DAFT requires you to operate a business in the Netherlands. This is the "entrepreneur" part of the visa.

What Counts as a Business

Almost any legitimate business activity qualifies:

  • Freelance/consulting — IT, marketing, design, writing
  • E-commerce — Dropshipping, handmade goods, digital products
  • Online services — Coaching, tutoring, virtual assistance
  • Creative work — Photography, videography, art
  • Import/export — Between US and EU markets
  • Software development — Apps, websites, SaaS
  • Content creation — Blogging, YouTube, podcasting

What "Active Business" Means

You don't need an existing business or prior business experience. Most DAFT applicants start their Dutch business as part of the application process. We registered ours after arriving.

The IND wants to see genuine business activity, not just a shell company:

  • Actually performing work or services
  • Pursuing revenue (profits can come later)
  • Having a reasonable business plan
  • Serving a legitimate market purpose

What Doesn't Work

  • Passive investments only — You need active involvement
  • Employment disguised as business — Must be genuine self-employment
  • Illegal activities — Obviously

Requirement 4: €4,500 Investment

You must demonstrate €4,500 (approximately $4,900 USD) invested in your Dutch business.

What Counts as Investment

  • Cash in Dutch business bank account — Most common
  • Equipment purchases — Computers, tools, machinery
  • Initial inventory — Products for sale
  • Business setup costs — Legal fees, permits, initial marketing

What Doesn't Count

  • Personal savings — Must be in business account
  • Money in US accounts — Must be transferred to Dutch business
  • Promised future investment — Must be actually invested

Important Clarifications

This is YOUR money, not a fee. The €4,500 goes into your own business. You control it and can use it for legitimate business expenses.

You can't just show a bank statement. The money must be invested in your registered Dutch business, typically shown through a business bank account statement after KVK registration.

Timing matters. You'll demonstrate this investment after arriving in the Netherlands and registering your business, not before your MVV application.

Requirement 5: Valid Passport

Your US passport must meet these requirements:

Passport Timing

If your passport expires soon, renew it before starting your DAFT application. A new passport won't delay your application if you renew early.

Q: Is there an age limit for DAFT?

A: No. There's no minimum or maximum age. We know DAFT permit holders from their 20s through their 60s. See DAFT Age Requirements for details.

Q: Can I apply if I have a criminal record?

Q: Do I need to have clients before applying?

A: No. You need a viable business plan and intent to operate a business, but you don't need existing clients or revenue.

Q: I don't have business experience. Can I still qualify?

A: Yes. DAFT doesn't require previous business experience. You need a viable business plan, not a business history.

Q: I work remotely for a US company. Does that count?

A: If you're an employee (W-2), that's not a business — you'd need a different visa. If you're a contractor (1099) with multiple clients, that's more defensible as a business.

Q: Can I live anywhere in the Netherlands?

A: Yes. DAFT applies to all of the Netherlands. Housing is actually easier and cheaper outside Amsterdam — consider Rotterdam, The Hague, Utrecht, or Eindhoven.

Q: What if I'm not sure I qualify?

Q: Can my non-US spouse come with me?

A: Yes. Your spouse can receive a dependent residence permit regardless of their citizenship. They'll have full work rights in the Netherlands.
