Can You Apply for DAFT After Moving to Netherlands?
"Can I move to Amsterdam first, then apply for DAFT?"
The short answer: yes, technically.
The longer answer: it's complicated, and applying before you move is usually easier.
The Answer
Yes, you can apply for DAFT while already in the Netherlands.
Requirements: You need to be in Netherlands legally (within your 90-day tourist visa), have a Dutch address, and have registered your business with KVK. See DAFT Requirements for full eligibility details.
The catch: The application process takes 2-4 months, and you'll need to leave before your 90 days are up.
Two Ways to Apply
Option 1: Apply from the US (Easier)
- Prepare application from US
- Submit to IND
- Wait for approval (2-4 months)
- Move once approved
Pros: Less stressful, not on a visa clock, can take your time.
Cons: Can't be in Netherlands during process, harder to find housing remotely.
This is what we did. Less stressful.
Option 2: Apply from Netherlands (Harder)
- Move to Netherlands (within 90-day tourist visa)
- Find housing, register with gemeente
- Register business with KVK
- Open bank account, deposit €4,500
- Submit DAFT application
- Leave Netherlands before 90 days
- Wait for approval outside Netherlands
- Return once approved
Pros: Already in Netherlands, easier to find housing in person.
Cons: Stressful, racing against 90-day clock, must leave during processing.
The 90-Day Complication
As a US citizen, you can stay in Schengen for 90 days out of any 180-day period without a visa.
If you apply from Netherlands and processing takes 2-4 months, you can't stay there while waiting. You'll use your 90 days setting up, then need to leave.
The risk: If processing takes longer than expected, you've used your 90 days and can't return until they "reset."
Our Recommendation
Apply from the US unless you have a specific reason to apply from Netherlands.
Why: Less stressful, no visa clock, more time to prepare, cheaper (not paying for housing you're not using).
The hybrid approach some people take: Visit Netherlands for 2-3 weeks to scout neighborhoods and maybe register business, then return to US and apply from there.

What If You Overstay?
Don't. Consequences include fines (€500+), entry ban (1-5 years), and could affect your DAFT application.
If you're approaching 90 days and your DAFT isn't approved yet, leave and wait outside Schengen.
